Habitat protection for species under the Endangered Species Act
78(1)No person shall
(a)
wilfully or knowingly destroy, disturb or interfere with the nest, nest shelter or den of an individual of a wildlife species set out in Schedule A, or
(b)
wilfully or knowingly attempt to destroy, disturb or interfere with the survival habitat or recovery habitat of an individual of a wildlife species set out in Schedule A.
78(2)On the recommendation of the Minister, the Lieutenant-Governor in Council may, by regulation, amend Schedule A by deleting a wildlife species from the Schedule.
